URGENT ACTION: Statement of Grievance: changes to post-retirement benefits

Dear OPS Highest-Ranking, 

The mass filing of individual grievances as an expression of our members’ outrage at the Wynne government’s arbitrary changes to post-retirement benefits, changes that were made without consultation or negotiation with OPSEU, was discussed at the OPS Caucus at Convention 2014.  It was decided members should file their grievances all on the same day, Monday, May 26.  Below is the statement of grievance. The grievance form can be found here. The mass filing of grievances should be understood as a campaign pressure tactic to get the employer to rescind its decision.

Statement of Grievance

1. We grieve that the employer has violated Article 2 of the CA and any other Article that may apply by failing to provide me with reasonable information concerning our employment relationship, namely the document which provides the origin of OPS employee’s post-retirement benefits.

2. We grieve that the employer has violated Article 2 of the CA and any other Article that may apply by announcing its intent to change our post-retirement benefit, arbitrarily and in bad faith.

3. We grieve that the employer has violated Article 3 of the CA and any other Article that may apply by changing the post-retirement benefits which discriminates against me based on age.

4. We grieve that the employer has violated Article UN 16 and COR 17 (as applicable) of the CA and any other Article that may apply by changing the post-retirement benefits that I have been afforded which are actually part of my salary.

Settlement Desired

1. Provide a copy of the document which provides for the OPS post-retirement benefits currently in place today, and the documents which enable the proposed changes.

2. Reverse the employer’s decision / intention to change OPS post-retirement benefits as of January 1, 2017.

3. Full redress and any other remedy that in the opinion of an arbitrator will make the grievor whole.
